Please read these terms and conditions carefully before participating. PUMA may change these Terms of Use at any time without notice, effective upon its posting to the Platform. This Contest is open only to an individual legal resident of the Republic of India and is 18 years or older at the time of entry. The winner shall be chosen from the entries of female participants; however, Organizers may in their own discretion choose winners from other genders as well and by entering into this contest, the Participants agree to the aforesaid unconditionally.
Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the promotion. Winning a prize is contingent upon fulfilling all requirements set forth herein.
To be entitled to participate in this Contest, the contestant needs to follow Puma India Instagram handle, and post a picture of themselves on Instagram along with a caption that explains what makes them a Propah lady, followed with a hashtag #PropahLady and #PropahLadyx98file; and tagging @pumaindia and @98file
The Contestant is eligible for entry from 17th October, 2019 till 23rd October, 2019. Entries submitted prior to or after an Entry Period will be disqualified. The Participants can post more than one entry; however, the same shall in no manner guarantee and/or increase the chances of winning. The Organizers shall endeavour to announce the winners by 30th October, 2019; however, the Organizers may at their sole discretion extend the date of announcement of the results.
Only such submissions of participants meeting the criteria as mentioned above, and are otherwise compliant with these terms and conditions, shall qualify for the Contest and shall hereinafter be referred to as ‘Valid Entries’ or ‘Valid Entry’. The decision of Puma with regard to validity of the entries shall be final and the Puma shall not entertain any claim or communication with respect to that entry by the participant.
Unless prohibited by law, entrants agree to allow use of their name, voice, city/state of residence, photograph, and/or likeness for advertising and/or trade and/or any other purpose in any media or format now or hereafter known without compensation, permission or notification
Out of the eligible entries, one winner will be selected purely on the basis on the quality of the post shared by them, and the number of likes and comments on them. 98file shall announce winners on Instagram on their social media handle. Participants will be adjudged on:
Maximum no. of likes and comments amongst all Instagram posts received during the Contest Duration;
Qualitative factors including but not limited to quality of post, creativity and the relevance of message content
Out of the eligible entries, ten winners will be selected as per terms above and will receive PUMA merchandise signed by Sara Ali Kham, Mary Kom or Dutee Chand. Each merchandise will amount to not more than Rs 5000.
The winners may be contacted by the representatives of 98file on the contact number/email id/Instagram account shared by him/her on the direct message inbox. Each winner would be contacted once over a period of 48 (forty-eight) hours. In case, the winner is not reachable, or he/she cannot redeem the Prize for any reason whatsoever, 98file reserve the right to either forfeit the Prize or pass on the Prize to another Participant, selected as per Clauses listed above, without any further notice to the winner who could not be contacted.
Puma shall not be responsible for any additional cost and/or allowance and the winner shall bear all additional costs.
Puma shall not be responsible for any damage, injury, including death during the travel, stay and during the “meet and greet” in any manner whatsoever
By participating in the Contest, the participants hereby agree to all the terms and conditions stated above and authorize Organizers to use in any manner whatsoever their photographs, videos and images. The Participants further indemnify Puma against any claim/loss accrued due to the authorized use of their images, videos, information and/or photographs. Winner, in the sole discretion of Puma, shall sign and return an affidavit of eligibility and a liability release and other terms and conditions within seven (7) days of the issuance of such documents or the prize may be forfeited and awarded to an alternate winner.
In case the participant is found using external random software that entail fake re-posting tools, he will be disqualified from the Contest. Puma has all rights to verify the credibility of the post and to forfeit the Prize in case the Participant is found to be using such tools/software to increase the number of shares/likes. The decision of Puma shall be final, and the participants shall accept the decision as a binding one and shall in no event contest the same. Subject to other terms and conditions contained herein, the participation shall be deemed to be made by the person who is the authorized holder of the Instagram account used to enter the Contest. In case a person uses the Instagram login credentials of another person and uses such account to participate in the Contest, then Puma would be within its rights to deny any claim of both such persons, i.e. the one who used the login credentials of another person as well as such other person.
The ruling of the jury panel of the Organizer PUMA and the procedure adopted by them shall be final and binding upon all the participants and no appeal or correspondence shall be entertained in this regard criteria. 98file shall endeavor to announce the winners by 30th October, 2019 98file Instagram handle; however, may in its sole discretion postpone the date of such announcement of results. It is strictly prohibited to upload content (picture/text/any other content) of any kind that contain expressions of hate, abuse, offensive images or conduct, obscenity, pornography, is sexually explicit or against any religious sentiments or against any caste, creed or race or any material, which is offensive to women or any material that could give rise to any civil or criminal liability under applicable law or regulations or that otherwise may be in conflict with these Terms and Conditions or the Advertising Code of the Advertising Standards Council of India. It is also clarified that any entry which, in the reasonable opinion of the Organizer, is obscene, offending or hurtful shall be rejected immediately; and appropriate action will be taken against the said Participant. Entries will be rejected/deleted and will not be deemed valid entries for the purposes of this Contest if they:
contain or display any commercial/corporate advertising other than that of Puma (including but not limited to corporate logos, brand names, trademarks, slogans, political, personal and religious statements);
reference persons or organizations without their written permission;
disparage any persons or organizations;
are unlawful, in violation of or contrary to any applicable laws and/or regulations.

All the prizes in the contest are non-transferable and cannot be licensed or assigned to any other individual and/or cannot be claimed/enjoyed/sought by anyone else other than the winners of the contest. Further, the prize cannot be substituted for any cash payment or barter of any kind. The selection of the winners of the Contest will be aggregated at the end of the Contest Duration. The winners will be notified as per Clause 5 and winners will be required to share a valid proof of identity and age in the form of a copy of PAN Card / Driving License / Voter ID / Indian passport. A PAN card copy is mandatory for prizes worth INR 10, 000/- (Rupees Ten Thousand Only) or more. The prize shall be considered as forfeited if the winner does not meet the eligibility criteria or does not comply with these T&Cs. Each Prize will be awarded "AS IS" and WITHOUT WARRANTY OF ANY KIND, express or implied (including, without limitation, any implied warranty of merchantability or fitness for a particular purpose). There are no cash or other prize alternatives available in whole or in part. If the winner does not respond back to any communications sent in relation to the Contest within the time period communicated, he/she shall not be eligible to be declared winner of the Prize. Puma's decision on the winner shall be considered as final. All the Puma merchandise/products provided to the winners shall be governed by the standard warranties.
By participating in the Contest, the Participants hereby agree to make themselves available for any promotional and/or marketing purposes and/or any publicity purposes. The participants further authorize Puma to publish including but not limited to the images, videos, quotes of the participants in any manner whatsoever in both online and offline media channels.
By entering in the Contest, the Participants hereby authorize Organizers to use their personal information including but not limited to names, photographs and/or any such personal data for any marketing or promotional campaigns. Such use of the data by the Organizers shall in no case be termed as invasion of privacy and personal rights and the participants further indemnify Puma from all such claims and/or loss. By entering the Contest, the participant consent to being placed on a mailing list for promotional and other materials for Puma. The participant may update or change their email preferences at the email preferences page.
Participation in this contest shall be limited to this contest only and in no manner shall entitle the participant to be eligible for any other contest that may be initiated by Puma in the future. Further, the participants shall comply/abide with the rules/instructions given by Puma and any non-adherence to the same shall result in disqualification. Any lack of cooperation shall entitle the Organizer to forfeit the Prize in its entirety or pass on the Prize to another Participant. Organizer shall not be liable for any loss or non-receipt of Prize due to incorrect details or the failure of any winner to take the delivery, for any reason whatsoever. The Organizer will not be liable for any failure to provide the Prize due to technical issues or any other logistical issues
In the event of any inconsistency between these terms and conditions and any advertising, promotional, publicity and other materials relating to or in connection with this promotion, these terms and conditions shall prevail
The Organizers has no control over and is not responsible if for any reason/s whatsoever, if the said prize/s cannot be availed/redeemed for any reason whatsoever and in no event shall be liable for any losses or any incidental or consequential damages whatsoever caused to the winner/s due to the same
By participating into this Contest, the Participant(s) agree that Puma shall not be liable for injury, loss, or damage of any kind resulting from participating in this Contest or from the acceptance or use/misuse of the prize/s awarded. This includes, without limitation, personal injury, death, and property damage, and claims based on publicity rights, defamation, or invasion of privacy. Organizers accepts no responsibility for late, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected participant entries submitted by email/Facebook/Twitter/Instagram/Tik-Tok or any similar means, whether due to error, omission, alteration, tampering, unauthorized data hacking, deletion, theft, destruction, virus attack, transmission interruption, communications failure, hardware failure or otherwise. To the fullest extent permitted by law, Puma hereby excludes all warranties, representations, covenants and liability (whether express or implied) regarding the Contest. The user shall be solely responsible/liable to comply and abide by the rules, regulations, policies and obligations as mandated by any social media channel including nstagram
None of the provisions of these terms and conditions shall be deemed to constitute a partnership or agency between Puma and participant and participant shall have no authority to bind Puma in any manner whatsoever
All rights, title and interest including but not limited to the Intellectual Property Rights in the promotional material(s) and any/all registrations received shall vest solely and exclusively with Puma at all times and Puma or any other of the Puma Group Companies, affiliates shall be entitled to use the articles, database, material of the entries received or any information in any media for future promotional, marketing and publicity purpose without any further reference or payment or compensation to you as a participant
Participants shall be solely responsible for any consequences which may arise due to any kind of infringement of copyrights or any kind of intellectual property rights belonging to any other person/ entity etc. and also undertake to indemnify Puma and its officers, directors, employees, etc. on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis
Organizers has no control over communications networks or lines and does not accept any responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. Puma is not liable for any consequences of user error including (without limitation) costs incurred. Puma reserves the right, in their sole discretion, to disqualify any individual found to be tampering with the participation process or the operation of the said Contest
Each participant agrees that he/she has read and understood these terms and by their participation in the contest, each participant agrees to be bound by the terms. Mere participation should not be perceived as any commitment on the part of Puma to select a participant as the winner.
